Welcome to PlazaX ("Platform," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the PlazaX website, mobile application, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Please read these Terms carefully before using our platform. If you do not agree to these Terms, please do not use our Services.

1. Definitions

• "Buyer" or "Customer": Any person who purchases products through our Platform.
• "Seller" or "Merchant": Any person or business entity that sells products through our Platform.
• "Products": Goods listed for sale on the Platform.
• "Order": A request to purchase Products through the Platform.
• "User" or "You": Any person who accesses or uses our Platform, including Buyers and Sellers.
• "Content": All text, images, videos, reviews, and other materials available on the Platform.

2. Eligibility and Account Registration

2.1 Eligibility

To use our Services, you must:

• Be at least 18 years old or have parental/guardian consent
• Be a resident of Pakistan or have a valid delivery address in Pakistan
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information

2.2 Account Registration

• You must create an account to make purchases on our Platform.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• Each user may maintain only one active account.

3. Buying on PlazaX

3.1 Product Listings

• We strive to display accurate product information, including prices, descriptions, and images.
• Product colors may vary slightly from images due to screen settings.
• Prices are listed in Pakistani Rupees (PKR) and include applicable taxes unless stated otherwise.
• We reserve the right to correct pricing errors and cancel orders affected by such errors.

3.2 Placing Orders

• By placing an order, you make an offer to purchase the selected Products.
• Order confirmation does not constitute acceptance; we reserve the right to cancel orders for various reasons including stock unavailability.
• You are responsible for providing accurate delivery information.
• Orders cannot be modified once confirmed, but may be cancelled within a limited time window.

3.3 Payment

• We accept various payment methods including Cash on Delivery (COD), Credit/Debit cards, JazzCash, Easypaisa, and Bank Transfers.
• Payment information is processed securely through our payment partners.
• For COD orders, payment is due in full upon delivery.
• We may require advance payment for high-value orders or specific product categories.

3.4 Shipping and Delivery

• Delivery times are estimates and may vary based on location and product availability.
• Standard delivery typically takes 3-7 business days within major cities.
• Delivery to remote areas may take longer.
• Risk of loss and title for Products pass to you upon delivery.
• You must inspect Products upon delivery and report any damage or discrepancies immediately.

4. Returns, Refunds, and Cancellations

4.1 Return Policy

• Most Products can be returned within 7 days of delivery.
• Products must be unused, in original packaging, and with all tags attached.
• Certain items (intimate apparel, personal care products, perishables) cannot be returned for hygiene reasons.
• Damaged or defective Products can be returned regardless of the 7-day window.

4.2 Refunds

• Refunds will be processed within 5-10 business days after receiving returned Products.
• Refunds will be issued to the original payment method.
• Shipping costs are non-refundable unless the return is due to our error.
• Store credit may be offered as an alternative to cash refunds.

4.3 Order Cancellations

• Orders can be cancelled before shipment.
• Once shipped, orders cannot be cancelled but may be returned after delivery.
• We reserve the right to cancel orders due to stock unavailability, pricing errors, or suspected fraudulent activity.

5. Selling on PlazaX (For Sellers)

5.1 Seller Registration

• Sellers must complete verification process including business registration and CNIC verification.
• Sellers must provide accurate business and tax information.
• We reserve the right to approve or reject seller applications.

5.2 Product Listings

• Sellers must provide accurate and truthful product information.
• Prohibited items include counterfeit goods, illegal products, and items violating intellectual property rights.
• Product images must accurately represent the actual item.
• Pricing must be competitive and inclusive of all applicable taxes.

5.3 Fulfillment and Shipping

• Sellers must ship orders within the specified handling time.
• Sellers are responsible for proper packaging to prevent damage.
• Sellers must use approved courier partners or PlazaX logistics services.

5.4 Commission and Fees

• Commission rates vary by product category and are deducted from seller payments.
• Payment processing fees may apply.
• Seller payments are processed on a weekly or bi-weekly basis.

6. User Conduct

You agree not to:

• Use the Platform for any illegal purpose or in violation of Pakistani laws
• Post false, misleading, or fraudulent content
• Interfere with the security features of the Platform
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems or bots to access the Platform
• Harass, abuse, or harm other users
• Upload viruses, malware, or other harmful code
• Infringe on intellectual property rights of others

7. Intellectual Property

• All content on the Platform, including logos, trademarks, text, graphics, and software, is owned by PlazaX or its licensors.
• You may not use our trademarks or branding without prior written consent.
• By posting content on our Platform, you grant us a non-exclusive, royalty-free license to use that content.
• We respect intellectual property rights and will respond to valid DMCA takedown notices.

8. Reviews and Ratings

• Users may post reviews and ratings for purchased Products.
• Reviews must be honest, accurate, and based on actual purchase experience.
• We reserve the right to remove reviews that violate our guidelines.
• Paid or incentivized reviews without disclosure are prohibited.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that our Services will be uninterrupted, timely, secure, or error-free. Product descriptions and images are provided by sellers, and we do not guarantee their accuracy.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLAZAX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the specific Product or service giving rise to the liability.

11. Indemnification

You agree to indemnify and hold harmless PlazaX, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our Services, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Dispute Resolution

• These Terms shall be governed by the laws of the Islamic Republic of Pakistan.
• Any disputes shall first be attempted to be resolved through negotiation.
• If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan.
• Alternative Dispute Resolution (ADR) may be used at our discretion.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of our Services after changes constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your access to our Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
